Terms of Service by MK Elite Web Design

1. Acceptance of Terms

• By using the services provided by MK Elite Web Design, you agree to comply with and be bound by these Terms of Service.

2. Scope of Services

• MK Elite Web Design provides website design and development services as outlined in individual contracts.

• Any major changes to the agreed-upon specifications will require a new estimate and contract amendment.

3. Payment Terms

• A non-refundable deposit is required before the website goes live.
• Clients must make ongoing payments to maintain website access.
• Late payments incur fees and may lead to suspension or deletion of the website.
• All payments are final, and chargebacks or disputes will result in legal action.

4. Website Ownership & Rights

• MK Elite Web Design retains full ownership of the website and domain.
• The website cannot be transferred to another provider without consent and payment.
• Non-payment results in website suspension or deletion.

5. Client Responsibilities

• Clients must provide all necessary content in a timely manner and ensure compliance with copyright laws.
• Failure to do so may result in project delays or placeholder content being used.

6. Revisions & Approval

• Clients are entitled to a set number of revisions per month, with additional revisions billed hourly.
• A project is considered complete upon final approval or after a set period without revision requests.

7. Cancellation & Refund Policy

• Deposits are non-refundable.
• Clients must provide 30 days’ written notice to cancel a monthly or annual plan.
• If cancellation occurs after work has begun, the client must pay for completed work.

8. Liability & Warranty

• MK Elite Web Design is not responsible for security breaches, downtime, or business losses related to the website unless a separate maintenance contract is signed.

9. Legal Action for Non-Payment

• Failure to make payments may result in legal action, and clients are responsible for associated legal fees.

10. Reactivation & Data Retention

• A setup fee applies if a canceled website is reactivated.
• Deleted websites may not be recoverable.

11. Governing Law & Dispute Resolution

• Disputes will be resolved through mediation or arbitration in [Benton County].

12. Agreement Acceptance:

• By using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
